Cell Phone Use - Primary Stop - As Of March
1, 2008

The Governor of
New Jersey signed into law an amendment to NJSA 39:4-97.3 which makes the
use of a cell phone by a person who is operating a motor vehicle a primary
offense. This means police may effect a motor vehicle stop upon viewing this
violation. The amended statute also makes it an offense to “text message”
while driving.
A conviction for the cell phone offense
carries a $100.00 fine.
Special Needs Registration for Emergency

without warning and it could require moving residents to a safer area. As
part of Atlantic City’s Disaster Preparedness Plan, Atlantic County has
developed a Special Needs Registry for residents who may have difficulty
evacuating the city. The Special Needs Registry will be used by first
responders (Police, Fire, Sheriff Officers, Emergency Medical Services,
Health Dept. Personnel, and if necessary, the Army National Guard) to assist
in relocating our residents prior to an emergency situation. For further

Pedestrians and Crosswalks
Recently there has been some controversy or
misunderstanding regarding Pedestrians crossing at crosswalks. Below is the
New Jersey Title 39 statute regarding pedestrian and motor vehicles within a
crosswalk;
39:4-36: The driver of a vehicle shall
yield the right of way to a pedestrian crossing the roadway within a marked
crosswalk or within any unmarked crosswalk at an intersection, except at
crosswalks when the movement of traffic is being regulated by police
officers or traffic control signals, or where otherwise prohibited by
municipal, county, or state regulation, and except where a pedestrian tunnel
or overhead pedestrian crossing has been provided,
but no pedestrian shall suddenly
leave a curb or other place of safety and walk or run into the path of a
vehicle which is so close that it is impossible for the driver to yield.
Nothing herein shall relieve a pedestrian from using due care for his/her
safety.
Whenever a vehicle is stopped to permit a
pedestrian to cross the roadway, the driver of any other vehicle approaching
from the rear shall not overtake and pass such stopped vehicle.
Every pedestrian upon a roadway at any point
other than within a marked crosswalk or within an unmarked crosswalk at an
intersection shall yield the right of way to all vehicles upon the roadway.
Nothing contained herein shall relieve a driver
from the duty to exercise due care for the safety of any pedestrian upon a
roadway.
